The Diffuse Mesothelioma Payment Scheme

The DMPS is a government-run scheme provides compensation to patients who suffer from diffuse mesothelioma. The DMPS can pay out large sums if a civil claim against an employer fails because the company is no longer in existence or their insurers aren't traceable.

What is the DMPS?

The DMPS is available to mesothelioma patients who have been diagnosed with mesothelioma diffuse but are not qualified for civil compensation. The scheme allows for an upfront lump sum of up to PS216.896 depending on the age of the patient at the time of diagnosis.

The DMPS is only available to people who have been diagnosed with mesothelioma caused by their own occupational exposure to asbestos and who have been not able to locate their former employer or their insurers. Therefore, it is not available to those who have been diagnosed with mesothelioma as a result of another exposure or who are unable to file a civil lawsuit without financial assistance.

This is a pity and a difficult circumstance for mesothelioma patients. It is also difficult to reconcile the fact that some sufferers will get no compensation, while others who could have recovered substantial compensation from a civil claim, will have that money withdrawn from them and deposited into the DMPS.

Asbestos-related victims should be compensated that is specific to their situation but not at the expense of other mesothelioma patients. The DMPS does not include any medical expenses, like immunotherapy and chemotherapy, which could have been necessary to ease symptoms or increase the life expectancy of patients.

It is also worth noting that mesothelioma patients' eligibility to claim social security benefits and/or compensation from their DWP employer will be considered by the DMPS administrator. This is an unjustified conflict of interest that should be stopped.

In the end, if a person with mesothelioma dies before making a DMPS, their heirs will have the right to file a DMPS. In contrast mesothelioma cases that are civil in nature are treated differently. If a person passes away before the three-year statute of limitations expires, their estate can pursue a compensation case. It is not clear why the DMPS has been set up on this basis. This issue has raised a number of questions. This is an area where I will continue to advocate for change.

How do I make a claim?

One of my clients has, for instance, developed mesothelioma after washing her father's asbestos-contaminated work clothing in his factory in Higham. She was not able to submit a mesothelioma claim against British Uralite, her father's former employer. She was awarded only PS18,675 for the result. The amount was not enough to pay her legal fees. This is an inherent injustice. Immunotherapy therapies are promising for those with mesothelioma, and it is crucial that those who are eligible receive the funding they require.
